Terms & Conditions

Effective Date: June 29, 2026

These Terms and Conditions govern your access to and use of HighmarkFlooring.com and the website features, content, forms, appointment tools, and resources offered by Highmark Flooring (“Highmark Flooring,” “we,” “our,” or “us”).

By accessing or using this website, you agree to these Terms and Conditions and our Privacy Policy. Please do not use the website if you do not agree to these terms.

1. Website Purpose

This website provides general information about Highmark Flooring, our flooring products, consultations, project-planning process, installation services, financing resources, promotions, and related services.

Website content is provided for general informational purposes. It does not constitute a binding estimate, proposal, sales agreement, installation agreement, warranty, financing commitment, or guarantee that any particular product, service, price, promotion, or appointment time is available.

Submitting a website form, requesting information, or scheduling an appointment does not obligate you to purchase flooring or services from Highmark Flooring.

2. Eligibility and Accurate Information

You must be at least 18 years old to submit an inquiry, schedule an appointment, request an estimate, or enter into a flooring transaction through information presented on this website.

You agree to provide accurate, current, and complete information when using our website forms or appointment tools.

You may not submit information using another person’s identity or contact information without that person’s permission.

3. Flooring Products and Product Information

Product photographs, room scenes, samples, displays, colors, patterns, textures, finishes, dimensions, specifications, descriptions, and performance information are intended to be representative.

Actual products may vary because of factors including:

  • Computer, phone, and display settings
  • Photography and lighting conditions
  • Natural variation in wood, stone, and other materials
  • Dye-lot, production-run, or shade variation
  • Pattern placement and direction
  • Texture and gloss variation
  • Product updates or manufacturing changes
  • Installation conditions
  • Product availability

Customers should review physical samples, product specifications, care instructions, and applicable manufacturer information before making a final flooring selection.

Small samples may not show the full range of color, character, shade, grain, texture, or pattern that will be visible in an installed floor.

Highmark Flooring does not guarantee that products shown on the website will remain available or unchanged.

4. Website Pricing and Project Estimates

Any pricing, price range, calculator result, monthly-payment example, promotion, or project example displayed on the website is for general planning purposes unless expressly stated otherwise in a written agreement.

Website pricing may not include every condition or service affecting a particular project.

Final project pricing may depend on factors including:

  • The flooring product selected
  • Product quantity and waste allowance
  • Carpet cushion or underlayment
  • Measurements and room layout
  • Stairs, landings, transitions, and trim
  • Furniture moving
  • Appliance or specialty-item handling
  • Existing-flooring removal and disposal
  • Subfloor condition and preparation
  • Moisture conditions
  • Delivery and product availability
  • Installation method and requirements
  • Applicable taxes, permits, or other charges
  • Conditions discovered before or during installation

A binding project price will be provided through a written proposal, sales agreement, work authorization, change order, or other document accepted by Highmark Flooring and the customer.

Unless expressly stated in a written agreement, website content does not constitute an offer to sell products or services at a particular price.

5. Promotions and Special Offers

Promotions, discounts, upgrades, rebates, and special offers may be subject to:

  • Stated beginning and ending dates
  • Product or service limitations
  • Minimum purchase requirements
  • Geographic restrictions
  • Availability
  • Manufacturer or lender requirements
  • Other disclosed terms

Promotions cannot be combined unless expressly stated.

Highmark Flooring may correct typographical errors or inaccurate promotional information. Any correction will not affect rights that cannot legally be limited.

Promotional details applicable to a purchase should be confirmed in the customer’s written proposal or sales agreement.

6. Consultations and Measurements

Highmark Flooring may provide complimentary, no-obligation consultations and project measurements.

During an in-home consultation, we may:

  • Discuss your flooring needs and preferences
  • Review the areas included in the project
  • Take measurements
  • Examine visible existing conditions
  • Discuss flooring products and installation options
  • Identify anticipated removal, furniture, stairs, transitions, or preparation needs
  • Prepare information for a proposal or estimate

Measurements and observations are based on areas that are reasonably accessible at the time of the appointment.

Items, furniture, stored materials, existing flooring, walls, cabinetry, fixtures, or other conditions may prevent full inspection of the project area.

A consultation or measurement does not guarantee that every concealed or unexpected condition will be identified before work begins.

7. Appointment Requests

Appointment requests are subject to confirmation and availability.

Selecting an appointment time through the website or a third-party calendar does not guarantee that the appointment has been accepted until you receive confirmation.

Highmark Flooring may contact you to confirm, change, reschedule, or obtain additional information about an appointment.

Please notify us as soon as reasonably possible if you need to cancel or reschedule.

Repeated missed appointments or inaccurate contact information may affect our ability to provide future appointments.

8. Flooring Purchases and Installation Services

Flooring purchases and installation services will generally be governed by separate written documents, which may include:

  • A proposal
  • Sales agreement
  • Work authorization
  • Installation agreement
  • Change order
  • Payment schedule
  • Product-care information
  • Manufacturer warranty
  • Financing agreement
  • Required cancellation notice

Those documents may include terms concerning products, quantities, deposits, payment, scheduling, preparation, delivery, installation, cancellations, returns, warranties, claims, and customer responsibilities.

When a signed project document conflicts with these website Terms and Conditions, the applicable signed project document will control the flooring transaction.

These website Terms and Conditions do not waive any consumer right that cannot legally be waived.

9. Cancellation Rights

Some transactions may be subject to cancellation rights provided by applicable law, including certain agreements entered into at a customer’s residence or away from Highmark Flooring’s normal place of business.

When a statutory cancellation right applies, the applicable written agreement or cancellation notice will describe that right and the procedure for exercising it.

Nothing in these website Terms and Conditions is intended to limit or eliminate a cancellation right required by law.

Any additional cancellation, return, special-order, restocking, or refund terms will be stated in the applicable written proposal or sales agreement.

10. Existing and Concealed Conditions

Flooring projects may involve conditions that are concealed, inaccessible, unknown, or not reasonably identifiable during an initial consultation.

These conditions may include:

  • Uneven subfloors
  • Moisture or water intrusion
  • Mold, mildew, odors, or biological contamination
  • Pet stains or damage
  • Structural movement
  • Damaged or deteriorated subflooring
  • Adhesive or residue
  • Multiple layers of existing flooring
  • Improper prior installation
  • Asbestos-containing or other potentially hazardous materials
  • Plumbing, electrical, heating, or mechanical systems
  • Conditions hidden beneath flooring, walls, cabinets, furniture, or appliances

Additional work, materials, professional testing, remediation, repairs, or schedule changes may be necessary when unexpected conditions are discovered.

Any additional work or pricing should be addressed through the applicable project agreement or change order.

Highmark Flooring does not provide environmental, structural-engineering, plumbing, electrical, mold-remediation, asbestos-abatement, or other specialized professional services unless expressly stated in writing.

11. Customer Responsibilities

Customer responsibilities for a flooring project will be described in the applicable written agreement.

Depending on the project, customers may be responsible for:

  • Providing safe and reasonable access to the property
  • Removing small, fragile, valuable, and personal items
  • Emptying furniture, drawers, shelves, closets, and storage areas
  • Securing pets
  • Identifying known moisture, structural, plumbing, electrical, or environmental concerns
  • Disclosing known hazardous materials
  • Providing access to electricity, water, climate control, and restroom facilities when reasonably required
  • Coordinating alarm systems, building access, parking, elevators, or property-management requirements
  • Protecting or relocating electronics, artwork, valuables, specialty furniture, and sensitive equipment
  • Maintaining appropriate temperature and humidity conditions
  • Following product-care and maintenance instructions

Highmark Flooring is not responsible for information or conditions that a customer knew about but did not disclose when that information would reasonably affect the project.

12. Installation Dates and Project Timing

Any installation date, completion date, delivery date, or project timeline is an estimate unless expressly guaranteed in writing.

Timing may be affected by:

  • Product availability
  • Manufacturer or distributor delays
  • Shipping or delivery interruptions
  • Weather
  • Site access
  • Customer-requested changes
  • Hidden or unexpected conditions
  • Subfloor preparation
  • Moisture or environmental concerns
  • Installer availability
  • Illness, emergency, or events outside reasonable control

Highmark Flooring will make reasonable efforts to communicate material scheduling changes.

A delayed estimated date does not automatically create a right to compensation or cancellation except as provided in the applicable written agreement or required by law.

13. Product Care and Maintenance

Flooring performance and appearance depend partly on proper care, maintenance, environmental conditions, and use.

Customers should follow applicable manufacturer instructions concerning:

  • Cleaning products and methods
  • Temperature and humidity
  • Moisture prevention
  • Furniture protection
  • Area rugs and mats
  • Pet care
  • Sunlight exposure
  • Rolling loads
  • Footwear
  • Maintenance schedules

Use of unapproved cleaning products, improper maintenance, excessive moisture, unsuitable environmental conditions, neglect, abuse, or damage may affect product performance and warranty coverage.

14. Warranties

Product warranties, when available, are provided according to the applicable manufacturer’s written warranty.

Manufacturer warranties may contain limitations, exclusions, maintenance requirements, claim procedures, and documentation requirements.

Any Highmark Flooring workmanship warranty or service commitment will be described in the applicable written sales or installation agreement.

Statements on the website do not create a warranty unless expressly identified as a warranty and included in an applicable written agreement.

Nothing in these Terms and Conditions limits a warranty or legal right that cannot lawfully be excluded.

15. Financing

Highmark Flooring may provide information or links relating to financing offered by an independent third-party lender.

Financing is subject to credit approval and the lender’s requirements.

Highmark Flooring does not make lending decisions and does not guarantee:

  • Approval
  • Credit limits
  • Interest rates
  • Annual percentage rates
  • Promotional financing terms
  • Monthly payments
  • Required minimum payments
  • Account-management decisions
  • Continued availability of a financing plan

Payment and financing examples displayed on the website are estimates unless provided directly by the lender as part of an approved financing agreement.

The lender’s application, privacy policy, disclosures, account agreement, and terms govern the financing relationship.

Sensitive financing information should be submitted only through the lender’s secure application system.
